These Terms of Service (the “Terms”) form a binding agreement between you and Zooko Health Pty Ltd (ABN 56 7 02 54 3 360), trading as Zooko Health, of Melbourne VIC, Australia. They apply whenever you use our website at https://zooko.online, request a quote, or purchase any of our health and wellness services. Please read them carefully. If you do not agree with these Terms, please do not use our website or services.

1. Who we are
Zooko Health Pty Ltd (ABN 56 7 02 54 3 360) operates the website https://zooko.online and provides health and wellness services from Melbourne VIC, Australia. In these Terms, “Zooko Health”, “we”, “us” and “our” refer to Zooko Health Pty Ltd, and “you” refers to any user of our website or client of our services.
2. Our services
We provide non-clinical health and wellness services, which may include personalised wellness programs, one-on-one lifestyle and wellbeing coaching, workplace wellbeing sessions, group workshops, and related educational resources. Our services are described on the Services page and are delivered in person across Melbourne VIC and online Australia-wide. The specific services, inclusions, schedule and fees for your engagement will be set out in your written quote or service agreement. Our services support general health and wellbeing and are not a substitute for medical care — see section 6 below.
3. Eligibility and your responsibilities
- You must be at least 18 years old to engage our services directly. Bookings for clients under 18 require the written consent of, and appropriate supervision arrangements with, a parent or guardian.
- You agree to provide accurate, current and complete information about your health, medications and relevant personal circumstances, and to tell us promptly if anything changes.
- You agree to follow reasonable safety instructions given by our practitioners, and to let us know if an activity feels unsafe or unsuitable for you.
- We may decline or discontinue a service, acting reasonably, where it falls outside our scope of practice, appears unsafe, or where required information has not been provided.
4. Quotes, bookings and payment
- All prices are quoted in Australian dollars (AUD) and include GST where applicable.
- Written quotes are valid for 14 days from the date of issue unless the quote states otherwise. You can request a quote at any time via our quote page.
- A booking is confirmed once we have received your acceptance of the quote and any deposit or first payment stated in that quote.
- Invoices are payable within 7 days of issue by the payment method stated on the invoice. Overdue amounts may, to the extent permitted by law, attract reasonable administration or recovery costs.
- We may adjust our published prices from time to time; the price in your accepted quote will be honoured for the validity period of that quote.
5. Cancellations, rescheduling and refunds
- If you need to cancel or reschedule a session, please provide at least 24 hours’ notice. Cancellations with less than 24 hours’ notice may attract a fee of up to 50% of the session price, and non-attendance without notice may forfeit the session fee.
- If we cancel or need to reschedule a session (for example, due to practitioner illness or unavailability), you may choose a rescheduled session or a full refund of any amounts you have paid for that session.
- Refunds for prepaid programs are handled case by case, having regard to services already delivered and your rights under the Australian Consumer Law (see section 7 below).
6. Health and wellbeing disclaimer
Our services are designed to support general health, fitness and wellbeing. They do not constitute medical advice, diagnosis or treatment, and our practitioners do not replace your doctor or other treating health practitioners. Before starting any program, we encourage you to speak with your general practitioner, particularly if you are pregnant, recovering from injury or illness, or managing a medical condition. If you are experiencing a medical emergency or an urgent health concern, contact your doctor, your nearest hospital emergency department or emergency services immediately.
7. Your consumer rights under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law, being Schedule 2 of the Competition and Consumer Act 2010 (Cth). Our services come with guarantees that they will be provided with due care and skill, be reasonably fit for any purpose you made known to us, and be supplied within a reasonable time. If our services fail to meet a consumer guarantee, you may be entitled to a remedy, which may include resupply of the services or payment of the cost of resupply, or, in some circumstances, a refund, in accordance with the Australian Consumer Law.
8. Limitation of liability
To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or in connection with these Terms or our services is limited to the fees you paid to us for the service giving rise to the claim. We are not liable for indirect, incidental or consequential loss, including loss of profit or opportunity. This clause does not limit or exclude any liability that cannot lawfully be limited or excluded, including liability in connection with consumer guarantees under the Australian Consumer Law.
9. Privacy
We handle personal and health information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our privacy practices — including what information we collect, why we collect it, and how you can access or correct your information — are set out in our Privacy Policy.
10. Intellectual property
All content on this website, and all program materials, plans and resources we create for the delivery of our services, are owned by or licensed to Zooko Health Pty Ltd and are protected by Australian and international copyright laws. You are granted a personal, non-transferable licence to use website content and your own program materials for your personal, non-commercial use. You may not reproduce, distribute or use them commercially without our prior written consent.
11. Third-party links
Our website may contain links to third-party websites or resources. These links are provided for convenience only, and we do not endorse and are not responsible for the content, policies or practices of any third-party site.
12. Governing law and general provisions
These Terms are governed by the laws of Victoria, Australia, and the Commonwealth of Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with your accepted quote or service agreement, form the entire agreement between you and Zooko Health in relation to the services.
13. Changes to these Terms
We may update these Terms from time to time. The current version is always published on this page, together with the effective date at the top, and material changes will be summarised here. Continuing to use our website or services after an update takes effect means you accept the updated Terms.

We aim to respond to written enquiries within two business days. Complaints are acknowledged promptly and handled fairly, and if a matter is not resolved to your satisfaction you may be able to take it to a relevant external dispute resolution body.
